Terms of Service

You buy a license key, the app works on your device. You own your files. We own the software. Don't redistribute it. AI output is your responsibility. BYOK means you're the API customer, not us. If something goes wrong, our liability is limited to what you paid us.

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and Progress Never Stops ("we," "us," "our"), the maker of Mulberry IDE. By purchasing a license, installing the application, or using the software, you accept these Terms. If you don't agree, don't use the software.

We may update these Terms. Material changes will be communicated by email at least 30 days before they take effect. Continued use after that date means you accept the update.

2. License

What You Get

When you purchase a subscription, we grant you a personal, non-exclusive, non-transferable, revocable license to use Mulberry IDE on devices you own, for the tier you paid for. The license is activated by a key we deliver to the email you provide.

What You Don't Get

This license does not grant you ownership of the software, its source code, or any intellectual property contained in it. You may not copy, modify, reverse engineer, decompile, distribute, sublicense, sell, or create derivative works from Mulberry IDE, except as explicitly permitted by applicable law.

Source-Available Components

Certain components of Mulberry IDE (file parsers, rendering engines, offline caching) may be released under a source-available license. These components are inspectable for transparency and trust purposes. Source-available does not mean open source — you may read the code but may not redistribute, modify for distribution, or use it in competing products unless the specific component's license says otherwise.

3. Your Data & Files

You own everything you create with Mulberry IDE. Your files, projects, code, AI conversations, exports, and creative output are yours. We claim no ownership, no license, and no rights to your content. Period.

Because the app is offline-first and stores everything locally on your device, you are responsible for backing up your own data. We cannot recover files lost due to device failure, accidental deletion, or any other cause.

4. AI Features

Local AI Model

The on-device AI model runs entirely on your hardware. No data is transmitted to us or any third party. You are solely responsible for how you use AI-generated output — including any code, text, or suggestions the model produces. AI output may be incorrect, incomplete, or unsuitable for your purpose. Review everything before relying on it.

BYOK (Bring Your Own Key)

The BYOK feature allows you to connect to third-party AI providers using your own API key. When you use BYOK:

  • You are the customer of that API provider, not us. Your use of their service is governed by their terms, their privacy policy, and their pricing.
  • We never see your API key. Your device connects directly to the provider's endpoint. We don't proxy, log, cache, or store any part of that exchange.
  • We are not liable for the availability, accuracy, safety, cost, or behavior of third-party AI services. If a provider changes their terms, raises prices, or produces harmful output, that is between you and them.
  • You are responsible for securing your API key. If it's compromised, contact the provider directly.

AI Output Disclaimer

AI-generated content (whether from the local model or BYOK providers) is provided "as is" without warranties. We do not guarantee that AI output will be accurate, complete, non-infringing, or fit for any purpose. You assume full responsibility for reviewing, testing, and deploying any AI-generated code or content.

5. Payments

Payments are processed securely through Stripe. We never see or store your card details — all payment data is handled by Stripe's infrastructure.

Subscriptions are billed monthly. If payment fails, your license key will be deactivated after a 7-day grace period. You may reactivate by resuming payment.

Refunds

If you're unhappy within the first 14 days of a new subscription, email us for a full refund. After 14 days, refunds are at our discretion. Partial months are not refunded upon cancellation — your access continues until the end of the billing period.

6. License Key

Your license key is personal to you. You may not share, sell, publish, or transfer your key. One key activates one user across their personal devices. If we detect key sharing or abuse, we reserve the right to deactivate the key without refund.

By activating a license key, you acknowledge that you have read and accepted these Terms and our Privacy Policy.

7. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the software beyond what applicable law explicitly permits
  • Redistribute the application or any part of it
  • Use the software to develop a competing product
  • Attempt to circumvent license validation
  • Use the software for any activity that violates applicable law

8. Termination

You can stop using Mulberry IDE at any time by canceling your subscription and deleting the app. We can terminate or suspend your license if you violate these Terms, with notice where practical. Upon termination, your license key is deactivated but your local files remain on your device — we can't touch those and wouldn't want to.

9. Disclaimers

Mulberry IDE is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to these Terms or your use of Mulberry IDE is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, regardless of the theory of liability.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the software, your violation of these Terms, or your use of AI-generated content.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Washington, United States. Any disputes will be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted by a single arbitrator. Each party bears their own costs unless the arbitrator rules otherwise. You agree to resolve disputes individually — class actions and class arbitrations are not permitted.

13. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Mulberry IDE. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right doesn't waive that right. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets — with notice to you.
